You may be eligible for an employment-based, first-preference visa if you are an alien of amazing capability, are an outstanding teacher or scientist, or are a certain international executive or supervisor. Each occupational classification has particular requirements that need to be fulfilled:

Your petitioning employer needs to be a U.S. company and intend to employ you in a managerial or executive capacity. The petitioner needs to have been doing company in the U.S. for at least 1 year, as a legal entity with a qualifying relationship to the entity that used you abroad in a supervisory or executive capability.

No labor certification is required.

* Criteria for Demonstrating Extraordinary Ability

In order to show you have actually sustained nationwide or global recognition and that your achievements have been acknowledged in your field of expertise, you must either consist of proof of a one-time achievement (major internationally-recognized award) or 3 of the 10 noted requirements below (or equivalent evidence if any of the criteria do not easily use):

- Evidence of invoice of lower nationally or worldwide acknowledged rewards or awards for excellence
- Evidence of your subscription in associations in the field which require outstanding achievement of their members
- Evidence of published product about you in professional or major trade publications or other significant media
- Evidence that you have been asked to judge the work of others, either individually or on a panel
- Evidence of your initial clinical, academic, artistic, athletic, employment or business-related contributions of major significance to the field
- Evidence of your authorship of scholarly short articles in professional or major trade publications or other significant media
- Evidence that your work has actually been shown at artistic exhibitions or showcases
- Evidence of your efficiency of a leading or critical function in prominent organizations
- Evidence that you command a high salary or other substantially high compensation in relation to others in the field
- Evidence of your commercial successes in the performing arts

** Examples of Documentary Evidence That an Individual is an Impressive Professor or Researcher

In order to demonstrate you are an outstanding teacher or scientist, you need to include proof of 2 of the 6 noted requirements listed below (or equivalent proof if any of the criteria do not easily apply):

- Evidence of invoice of significant rewards or awards for impressive achievement
- Evidence of membership in associations that require their members to show outstanding achievement
- Evidence of published material in expert publications composed by others about the alien's operate in the academic field
- Evidence of involvement, either on a panel or separately, as a judge of the work of others in the same or field
- Evidence of original clinical or scholarly research contributions in the field
- Evidence of authorship of scholarly books or articles (in academic journals with global blood circulation) in the field

Application Process

Extraordinary Ability: You might use for yourself by submitting a Kind I-140, Petition for Alien Worker.
Outstanding Professors and Researchers: Your U.S. company need to file a Type I-140, Petition for Alien Worker. As part of the application process, your company needs to be able to demonstrate a continuing capability to pay the provided wage as of the top priority date. Your company might use an annual report, federal tax return, or audited financial statement to show a continuing ability to pay your wage.
Multinational Manager or Executive: Your U.S. employer should file USCIS Form I-140, Petition for Alien Worker.
